         The 300+ year old oak tree in back of the Moravian Church in Victoria has been cut down.  It was feared that it was becoming rotten and would fall and hurt someone or something.

To the Editor:

         Minnesota State Senator Julianne Ortman of Chanhassen authored a letter to request that MN Attorney General Lori Swanson review MN Senate File 783/House File 826, the "Safe and Supportive Minnesota Schools Act" currently pending in the Senate's Finance Committee.

         Regarding the request, Senator Ortman  offered the following statement:  "Our Attorney General has taken the solemn oath of office as we have in the Senate to support the Constitution of the United States and the Constitution of the State of Minnesota.

         "Fidelity to the Constitution is our highest obligation as elected officials.  Now is the time for Attorney General Swanson to act to protect and defend our State and its residents against unconstitutional encroachment by the state government."

         Senator Ortman's letter requested that Attorney General Swanson immediately provide an analysis of the constitutionality of the provisions of the "anti-bullying" legislation both on its face and as each of the provisions would be applied and implemented in Minnesota's public and private schools if signed into law.

         Minnesota already has an anti-bullying law, authorizing local school districts to enforce violations of the law and encouraging educational efforts, outreach, awareness, and sensitivity training.

         Enacting S.F. 783/HF. 826 would give state government new sweeping power and control over local school districts and create expensive and complex administrative and supervisory burdens for local school boards, superintendents, principals, and teachers, and an unconstitutional regulatory scheme.

         In addition to Senator Ortman, the letter was signed by 26 other members of the Minnesota Senate.

EDITOR'S NOTE:  On April 12th, Senator Ortman received a letter from Deputy Attorney General Christie Eller stating, "The authority of the Attorney General's Office to render formal opinions pursuant to statute is limited.  That authority does not extend to providing opinions at the request of individual legislators.  Furthermore, the Office does not generally undertake to render opinions on the constitutionality of proposed state statutes."

         The Ray Schmieg family would like to thank everyone for their thoughts and prayers and gifts upon the death of Ray on April 15th, 2013.  We would like to thank everyone who brought flowers, food, and for their cards and remembrances.  Thank your especially to the Victoria House -- Bobby, Dan, John and their kitchen staff -- for providing so much delicious food and thank you to all of the volunteers in the kitchen at St. Victoria for helping to serve us.

         Thank you to Father Bob White, Sue Orsen, Patty Schlader, Tom Kocka, and Art Johnson for the wonderful and memorable  Mass and Music.
