RULES AGAINST FUNK ET AL.

         The Minnesota Supreme Court agreed in July 2018 with both the Carver County District Court’s ruling of March 2016 and the MN Court of Appeals ruling in November 2017:  Victoria city councilmembers cannot be removed from office because of Open Meeting Law violations.  Public officials have opportunity to correct OML practices.

         Wrote Kandis Hanson in an email, “Very soon I will be offered the City Manager position in Victoria.  The mayor has been talking to me for months.  My appointment will take place at their meeting Monday night.”

 

MAYOR FUNK’S PLAN

FOILED BY SUPREME COURT RULING

         Said Mr. Funk, “When I heard the Supreme Court decision was coming down, and not knowing which way it was going to go, I had every intention to be prepared in case they removed the elected officials.”

 

RESIDENT CARA COON TO MAYOR FUNK:

“YOU’RE NOT LISTENING TO THE REST OF US”

         “Your plan apparently included firing Mr. Reeder and hiring a new city manager.  It appears you were violating city ordinance, potentially breaking the law, attempting to do all that outside, with what appears to be back-room dealings, without proper public notification as to what was going to occur at tonight’s meeting.”

 

KANDIS HANSON CAUGHT

IN THE QUAGMIRE WITH REGRETS

         “I regret and I apologize for that email … I regret that I spoke casually … I regret the email now but couldn’t have foreseen what was coming … I also regret being caught in your quagmire …”

 

RESIDENT JUDY BLACK TO MAYOR FUNK:

“I’M NOT FEELING TRANSPARENCY HERE”

         “You may need to readjust some of your thinking for the good of all the people, not just the certain ones that you’re affiliated with.”

 

RESIDENT TOM O’CONNOR TO MAYOR FUNK:

“YOUR CAMPAIGN OF MISINFORMATION CONTINUES”

         “Something is still terribly wrong in our city.  There remains a deep divide among our residents.”

 

INTERIM CITY MANAGER DOUG REEDER:

“MR. MAYOR, I FIND THIS VERY DISTURBING”

         “If the mayor continues his derogatory comments about staff in the social media and in public actions, or comments, I will personally support any staff that brings legal action against the City of Victoria for hostile workforce or gender harassment.”

 

COUNCILMEMBER TOM STRIGEL:

“IT APPEARS SOMEBODY IS NOT BEING TRUTHFUL”

         Said Councilmember Strigel, “I think it completely disqualifies Ms. Hanson from any potential consideration for this position — permanent, temporary, or in any other case.  It’s a bullying stance and a completely dependent view on whatever your will is, Mr. Mayor.”

 

COUNCILMEMBER TOM GREGORY:

“I WAS JUST AS SHOCKED AS ANYBODY”

         “I guess I knew that there may have been or had been conversations with Ms. Hanson.  The mayor has conversations with lots of people.”

 

COUNCILMEMBER TOM VOGT:

“THE MAYOR IS OUT OF LINE”

         “Apparently Kandis, because she uses the term ‘I’m going to bring calm’ and said ‘internally it’s chaos’ — someone told here there was chaos.  Where would she get that impression?  From Mr. Funk.”

 

FINANCE DIRECTOR KELLY GRINNElL:

“THE EMAIL IS OFFENSIVE, DEMEANING, SEXIST”

         Said Kelly, “I’d like to report there is no chaos.  The employees I work with are constantly working to improve effectiveness and efficiency in City Hall.  They work to serve with honest and integrity.”

 

COUNCILMEMBER JIM CROWLEY:

“WHAT ARE THE LEGAL RAMIFICATIONS?

         “All you have to do is lead and focus on the betterment of Victoria.”
